Product warranty

  1. The Seller guarantees to the Buyer that the Products will be delivered in perfect condition for use and preservation, and free from any type of damage or encumbrance.

  2. The warranty period for the Products shall be one year from the date of delivery of the Products to the Seller's warehouses. For Consumers, the warranty period for the Products shall be three years from the date of delivery of the Products to the Seller's warehouses.

  3. The validity and application of these warranties and remedies are conditioned on the following:

    1. the proper storage, installation, use, and maintenance of the Products and compliance with the instructions for proper installation, operation, and maintenance provided by the Seller or its suppliers or subcontractors;

    2. that the Buyer maintains appropriate records of the installation, operation, and maintenance during the warranty period, subject to the Seller having access to such records; and

    3. that any modification or repair of the Products shall be made only as authorized by the Seller. The Seller does not warrant the Products, or any repaired or replaced products, against normal wear and tear, or against damage caused by improper installation, accident, or use contrary to the Seller's recommendations or contained in the instruction manuals. Any modification or repair of any Product not authorized by the Seller shall render the warranty null and void.

  4. If the Products do not meet the aforementioned conditions, the Buyer shall immediately notify the Seller in writing within the warranty period. The Seller shall thereafter, at its sole discretion and always after testing to determine the existence and cause of the defect, repair or replace the defective Products. If, in the Seller's opinion, any Product cannot be repaired or replaced, the Seller shall refund or credit the Buyer the price paid. Any repair or replacement by Seller, as provided herein, will not extend the applicable warranty period. The costs of testing performed to determine the existence and cause of the defect in the Products shall be borne by Buyer if the result of the testing determines that there is no manufacturing defect, but that the defect is due to another cause.

  5. The costs of access to the premises where the defective Products are located shall be borne by Buyer, including the removal and replacement of systems, structures, or other parts of the premises of Buyer or its third parties, deinstallation, debugging, reinstallation, and transportation of the Products to Seller and back to Buyer or its third parties.

  6. This section contains the sole warranty for any claim based on failure or defect in the Products, regardless of whether the defect arises before or during the applicable warranty period, and whether the claim, however described, is based on contract, warranty, tort (including negligence), strict liability, or otherwise. The warranties provided in this section are exclusive and supersede any other verbal or written warranties, whether implied or established by law.

  7. In the case of Consumers, the provisions of current Spanish law shall apply. The right of withdrawal shall not apply to the sale of Products or installations that are custom-made or require customization.
